Late Wednesday night, Congress passed a continuing resolution (CR) to re-open the government through January 30, 2026, ending a 42-day shutdown. 🎉
Good news for H-2B!
After four (4) weeks of sitting idol, DOL had already resumed processing and the FLAG portal became live again on Friday, October 31st 🎃, while USCIS remained open—sending our team rushing to the finish line with emergency filing submissions.
Our team did an outstanding job managing the backlog — we’ve caught up on all bottlenecked cases, even utilizing emergency filing procedures when necessary to keep our clients on track.
We’re proud of our team’s commitment and grateful for our clients’ patience during this challenging time. 💪
📨 2026 Supplemental H-2B Visa Release – Take Action!
Please, PLEASE everyone — do your part to help support the release of the 2026 supplemental H-2B visas ASAP by contacting your Member of Congress. Your voice matters! Even though Congressed passed a CR, we still need the Departments of Labor and Homeland Security to release the full number of H-2B visas authorized by Congress.

📅 2026 H-2B Season Planning – Expect Worker Delays
The government shutdown will likely cause a trickle-down effect of delays across the board. Additionally, the Department of State has been instructed to resume in-person interviews for all H-2B workers, creating additional bottlenecks at the worker appointment stage due to limited staff resources.
👉 Therefore, employers should expect delays in worker arrivals for the 2026 season.
We’ve already prepared for the 2026 season to keep our clients ahead of the curve.
